Rajasthan: On Wednesday, Vice President Jag deep shankhar questioned the 1973 Kesavananda Bharat case verdict, which established the fundamental structure doctrine. He claimed that it set a bad precedent and that it would be difficult to argue that "we are a democratic nation" if any authority questioned Parliament's right to amend the Constitution.
Mr hankhar disapproves of the Kesavananda Bharat case decision that Parliament cannot modify the Constitution because of its fundamental structure. He once more criticized the Supreme Court for repealing the National Judicial.
The fundamental structure principle served as the justification for overturning several constitutional changes, including the one concerning the appointment of judges to the higher courts.
The top court found that the law breached the fundamental constitutional principle of judicial independence in the NJAC decision.
The chairman of the Rajya Sabha, Mr shankhar, stated on Wednesday that legislative independence and sovereignty are fundamental to the survival of democracy and cannot be compromised by the executive or judicial branches.
He stated that the court could not interfere with the legislative process while speaking at the 83rd All India Presiding Officers Conference.

Mr. shankhar described the NJ AC Act's repeal by the judiciary as "a scenario that may be unique in the democratic history of the globe."
"The executive is mandated to uphold the constitutional requirements coming from Parliament. It was required to follow the NJ AC. A judicial ruling cannot invalidate it, "said he.
He continued by saying that neither the executive nor the judiciary may undermine or dilute parliamentary sovereignty.
