WHAT IS CYBER TERRORISM?

Against the backdrop of recent computer attacks, many people have concluded that a new breed of terrorism is on the rise and that our country must defend itself in every possible way.  

As a society, we have abundant operational and legal experience and proven technology to fight terrorism, 

but are we ready to fight terrorism in cyberspace in a new field?

 

 

Combat strategic planning features enemy targets, operational techniques, resources, and agents. 

The enemy must be defined precisely before combat action can be taken on the legislature and the action front.

That is, it is essential to broaden the definition of terrorism to include cyber-terrorism.

 

 

As a society that prides itself on the fairness of justice, 

we must provide clear and definitive legal guidance to counter the new breed of terrorism.  

As things stand now, a clear definition of this term cannot yet be judged.  

In light of this, I propose to re-examine our understanding of cyber-terrorism.

There are many misinterpretations in the definition of cyber-terrorism; the term is made up of the familiar “cyber” and the less familiar “terrorism.” 

Although “cyber” refers to anything related to our business tools, it is difficult to describe terrorism by nature. 

 

 

WHO ARE THE CYBER TERRORISTS?

From America's point of view, the most dangerous terrorist group is Al Qaeda, which is considered America's first enemy.  

According to official U.S. statistics on computers seized in Afghanistan, the group has discovered systems that control the U.S. 

Energy facilities, water distribution, transportation systems, and other critical infrastructure.

 In April 2001, after a collision between a US Navy spy plane and a Chinese fighter jet, Chinese hackers launched a Denial of Service (DOS) attack on an American website.

A study conducted in late 2002 found that the most dangerous country for the origin of malicious cyber-attacks was the United States. 

 

 

WHY DO THEY USE CYBER ATTACKS?

Cyber ​​terrorists prefer to use cyber attack methods because it has many advantages. 

Cheaper than traditional methods.

It isn't easy to keep track of the action.

They can hide their personality and location.

They can use this method to attack a large number of targets.

They can affect a large number of people.

 

 

INDIAN  LAW AND CYBER ​​TERRORISM :

There is no law in India that is particularly relevant to prevent malware through aggressive protection.  Similar provisions should be made on purpose.  

Protection from malware attacks can be claimed in the following categories:

 (1) Protection available under the Constitution of India and 

(2) Security is available as per other rules.

 

 

 (1) Protection under the Constitution of India:

The protection available in the constitution of any country is the strongest and safest because it is the supreme document, and all other laws derive their power and legitimacy from it.

If the law satisfies rigorous tests of constitutional validity, its applicability and validity cannot be challenged, and it becomes completely binding.

Like other world elements, the Indian Constitution is organic and natural and can adapt to the times and needs of society.

 

 

 (2) Protection under other laws:

The protections available under the Constitution are further strengthened by various statutory acts.  

These protections can be classified as: 

(A) Indian Penal Code (IPC), 1960 and internal protection

(B) Protection under the Information Technology Act (ITA), 2000.
