TOP 5 RESPONSIBILITIES OF THE FOOD BUSINESS OPERATORS

(1)  Every food business operator shall ensure that the item of food satisfy the requirements of this act so that the rules and regulations are made in all parts of the business like production, processing, import, sale, and distribution so that everything should be in control. For every single aspect, there are some rules which are applied for the interest of public health.

 


(2) Food business operator or any person on his behalf shall not manufacture, store, sell or distribute any item of food -

 


(i)   which is not safe; or

 


(ii)  which is false, misleading, not meet the specific standards or contained in an article of food which may be carried from the raw materials, packaging materials, or process systems used for its manufacture; or 

 


(iii)  the food items for which a license is required, except by the conditions of the license; or

 


(iv)  the food item which is banned for the time being by the Food Authority or the Central Government or the State Government in the interest of public health; or

 


(v)  in violation of any provisions of this Food Safety and Standard Act or of any rule or regulation made thereunder. 

 


(3) no food business operator must employ any person suffering from an infectious, contagious, or loathsome disease, for that medical certificate can be the solution for avoiding the appointment of an infectious person in the protection of customer health. 

 


(4) The food business operator shall not sell or offer for sale any food item to any person who sells your products until he also gives a guarantee in writing in the form of specified by regulations about the nature and quality of such food item to the vendor ( the person who sell something ) -

 


                                     Provided that a bill, cash memo, or invoice in respect of the sale of any food item given by a Food business operator to the vendor shall be given a guarantee under this section, even if a guarantee in specified form is not included in the bill, cash memo or invoice. 

 


(5)  If any food which is not safe is part of a batch, lot, or consignment of food of the same class or description, it shall be presumed that all the rest of the food in that batch, lot, or consignment is also not safe unless it follows detailed assessment and analysis within given specified time if it is found that there is no evidence that the rest of food batch, lot or consignment is not safe then only the rest of the food batch has resumed. At the same time, the other unsafe food is sealed for further investigation according to Food Safety and Standard rules.

 


                                         This food can be provided that any conformity of food with specific provisions applicable to that food shall be without prejudice to the relative authorities taking appropriate measures to impose restrictions on that food being placed on the market or to require its withdrawal from the market for the reasons to be recorded in writing where such authorities suspect that despite the conformity, the food is unsafe.
