According to YTN on the 6th, the military prosecution has initiated an investigation into A on charges of unauthorized departure without permission from the commanding officer (battalion commander) during working hours, as well as unauthorized release of medication without approval from the Chief of Staff, and conducted a suspect interrogation on the 5th.
A's attorney, Lawyer Kim Kyung-ho from the Law Office Ho-in, revealed through the media on the 6th that the suspect interrogation was conducted the previous day but remained incomplete. They announced their intention to submit additional statements and opinions to exercise the right to defense.
A asserts that her visit to the Shin-gyo-dae of the 5th Division was in response to a request for cooperation in the duties of the nurse officer in that unit. Furthermore, she claims to have reported to the duty officer (military officer) on two separate occasions prior to the incident, supporting her stance that it was not an unauthorized departure.
In light of this, Lawyer Kim provided further clarification, stating, "Regarding Nurse Officer A, who holds the rank of Lieutenant, if we acknowledge that the duty officer is the primary decision-maker and the commanding officer of the duty unit, it follows the provisions outlined in the 'Regulations on Delegation and Assignment of Administrative Authority.' Accordingly, the responsibility for handling the administrative affairs of the duty unit rests with the duty officer."
Moreover, he emphasized, "The battalion commander assumes the role of supervising and overseeing these matters (command and supervision). When exercising authority over the administrative affairs of the duty unit, it is imperative that such actions are undertaken in the name of the duty officer as authorized by the duty officer."
Continuing the discussion, Lawyer Kim posed a question, "For example, if a duty officer from one battalion needs to go on leave for about an hour annually to assist with tasks in another division, should they report to the battalion commander? Or would it be considered 'unauthorized departure' if they don't report and go directly?" He further argued, "The duty officer, who has been given delegated authority by the battalion commander, approving the duty officer's leave to the adjacent division while considering the responsibilities of the battalion at the time, is also considered as 'approval from the commanding officer'."
Previously, Beta News reported, based on an anonymous tip-off, that A had allegedly left the unit without permission and visited the 5th Division, where BTS member Jin is stationed, administering a second dose of vaccination for epidemic hemorrhagic fever.
As a result, the military authorities postponed the disciplinary committee hearing scheduled for the 16th of last month regarding A and requested an investigation. Currently, the military prosecution is conducting an ongoing investigation into A.
Earlier, Beta News reported last month, citing an anonymous tip, that A allegedly left the military unit without permission and visited the 5th Division, where BTS member Jin is serving, to administer a second dose of vaccination for epidemic hemorrhagic fever.
As a result, the military authorities postponed A's disciplinary committee hearing, which was originally scheduled for the 16th, and requested an investigation. The military prosecution is currently conducting an ongoing investigation into A.
According to the military authorities, further investigation is required due to discrepancies in the statements provided by the individuals involved. They added that appropriate actions will be taken based on the investigation's results, in accordance with the law and regulations.
