West Bengal Chief Minister Mamata Banerjee, in her letter to the Prime Minister, said this would create an “atmosphere of fear” among the officers and affect their performance. In a letter to Modi on the subject for the second time in eight days, Banerjee said the amendment would “destroy” the federal fabric and the basic structure of the Constitution. He warned that if the Center does not reconsider its decision, there will be a “big agitation”.
The Chief Minister said, “I appeal to you to heartily reconsider this step of the Central Government and not to grow fire in the direction of this proposed amendment. I request you that we should not be pushed on this issue to such an extent that we are compelled to make a big movement to protect the soul of this great democracy which is and has been India.
Banerjee also said that the proposed changes, if implemented, would cause “irreparable” damage to the spirit of respect between the Center and the state for each other’s sentiments.
What is the IAS (Cadre) Rules, 1954
According to the IAS (Cadre) Rules, 1954, although officers are recruited by the center, but when they are allotted their state cadres, they come under the state government. This is how the federal structure works. According to the IAS cadre rules, an officer can be deputed for service under the Central Government or any other State Government only with the concurrence of the concerned State Government and the Central Government.
According to this rule, in case of any disagreement, the Central Government takes the decision and the decision of the Central Government is implemented by the State Government. This rule was added in May 1969 in the case of deputation giving more discretionary powers to the Centre.
What did the Ministry of Personnel say in the proposal
On the other hand, the Personnel Ministry said in the proposal to amend the IAS (Cadre) Rules, 1954, “As a result, the number of officers available for central deputation is not sufficient to meet the requirement at the Centre.”
In order to change the rules, the Center has proposed that every State Government shall make available for deputation to the Central Government eligible officers of different levels to the extent of Central Deputation Reserve prescribed under the existing rules.
According to the proposal regarding the new rules, the actual number of officers to be sent on deputation to the Central Government will be decided by the Central Government in consultation with the concerned State Government. It states that in case of any disagreement, the decision will be taken by the central government and the respective state governments will implement the decision of the central government in due course.
The existing rules do not specify any time frame for the decision in the event of such disagreements.
The proposal to change the rules was sent to the Chief Secretaries of all the state governments on December 20, 2021. He was asked to submit his remarks by January 5, 2022.
