The formalities to be completed to create a micro-enterprise depend on the legal status chosen to exercise the activity. A micro-entrepreneur has the choice between 3 different legal statuses, We will not discuss here the case of EIRL since the Independent Law provides for the abolition of this status. The online procedures are simple and few for the micro-enterprise constituted in the form of the sole proprietorship. All you have to do is complete a declaration of start of activity and send some supporting documents. They are, on the other hand, more complex for the micro-enterprise created under the status of (infrequent in practice).
Create an online micro-enterprise under the status of sole proprietorship
The sole proprietorship under the micro regime is the most common form of microenterprise. It is the one that is most frequently encountered in practice because this combination allows to benefit from a maximum of accounting, fiscal and administrative reductions. Its creation is also much less complex than with a micro regime (see below).
The whole procedure can be done on the Internet. You simply have to create an account on the site concerned and fill in the requested information. In particular, a declaration form for the start of an activity must be completed on the screen (P0 CMB micro-entrepreneur form for craftsmen and traders or P0 PL micro-entrepreneur form).
Finally, documents and supporting documents should be attached to the file. The married entrepreneur must inform his spouse about the consequences on the common goods of professional debts and provide a certificate to this effect. He must also provide his identity document (passport, national identity card) and a certificate of non-conviction and parentage.
Once the file has been validated, the platform automatically transmits it to the organizations concerned. It then issues an acknowledgment of receipt. Then, in the presence of a complete and compliant file, the CFE proceeds to the registration of the micro-enterprise. He enters it in the relevant register.
Create an online micro-enterprise under EURL status
First of all, it should be noted that a EURL can only opt for the micro-enterprise regime (micro-BIC or micro-BNC ) if the single partner simultaneously exercises the functions of manager. In addition, he must be a natural person, that is to say an individual. The company must be subject to income tax .
To create an EURL, it is first necessary to write a draft statute. The sole shareholder must provide the funds - and possibly the assets which represent the share capital. If he pays money, he must deposit the funds in a blocked bank account. We are talking about the deposit of social capital .
Then, he must publish a legal announcement of creation in an authorized medium. Finally, he must submit the application for registration of his EURL, accompanied by a declaration of incorporation form (M0 SARL) in which he declares his option for the micro-enterprise regime .
Each of these steps can be done online, on the Internet without having to travel or send a paper file. For that, here are some tips:
Drafting of the statutes : the sole partner can retrieve a free model of EURL statutes and personalize it (that of the Coin Des Entrepreneurs for example);
Deposit of share capital : funds can be deposited with an online bank which quickly issues the blocking certificate (72 hours maximum);
Publication of the legal notice : online press services can now publish legal notices. They deliver the certificate immediately;
Completion of the M0 SARL form : entry is made directly on the screen, online , during the registration stage (see below);
