Every country has a responsibility to investigate any action that is suspected to be a war crime. Senior police officials in the United Kingdom have offered to help Ukraine with evidence-gathering. There have been many courts since World War II. These include the Tribunal for War Crimes, formed after the breakup of Yugoslavia. An agency was also set up to try those involved in the genocide in Rwanda. Now the International Criminal Court (ICC) and The International Court of Justice (ICJ) are working to uphold the rules of war. The ICJ works with conflicting states. They cannot judge a person. Many analysts believe that aggression in Ukraine is a crime. Is it possible to prosecute suspected war criminals? Every country has a responsibility to investigate any activity suspected of being a war crime. Among them is the Tribunal for War Crimes, set up after the break-up of Yugoslavia. A body was also set up to try those involved in the genocide in Rwanda. The main protagonists of the horrific massacre planned by Hitler's forces during World War II were brought to justice at the Nuremberg Tribunal. This was the first time in the history of the world that a war crimes trial was held on such a large scale. Can ICC try crimes in Ukraine? ICC Chief Prosecutor British lawyer Karim Khan QC. He says there are good reasons to believe that war crimes are being committed in Ukraine and that he has permission to investigate. The investigation will look into past and present allegations. That could go as far as Russia's occupation of Crimea in 2013. If there is evidence of a charge against a person, the prosecutor can apply to the ICC judges in The Hague to issue an arrest warrant for their trial. This is where the limitations of the court come into play. Because the court does not have its own police. You have to rely on the police of the country concerned for the arrest. But Russia is not a member of this court. They moved away in 2016. Vladimir Putin will not extradite anyone. Is it possible to try President Putin and other leaders? As easy as it is to identify the soldiers who commit war crimes, it is just as difficult to blame the leaders who do it. But the ICC may take coercion as a crime. It came from Nuremberg. Where the Moscow-nominated judge felt that Nazi leaders should be tried for crimes against peace. But Professor Philip Sands, an international law analyst, said the ICC would not be able to try Russian leaders because Russia was not a signatory to the court. Theoretically, the Security Council could ask the ICC to investigate. But Russia, as a permanent member, can also veto it. Is there any other way to judge? The effectiveness of the ICC or the application of international law does not depend on the agreement alone. Rather, it is a matter of politics and diplomacy. That is why many, like Nuremberg, think the solution lies between diplomacy and international agreements. They also called on world leaders to establish a tribunal to try the perpetrators of the aggression in Ukraine.
