A legal expert expects Johnny to win his counter appeal against Amber! If you remember correctly, the Virginia court, in June, ordered Johnny Depp to pay $2 million to his ex-wife Amber Heard. Depp owes Heard this hefty sum of money because the Aquaman actor counter sued him and one of his lawyers, Adam Waldman, when he dubbed her accusation. But Depp isn’t ready to go down without a fight and plans on appealing to have these damages removed, and a legal expert seems to think he stands a very good chance of winning his appeal. A Texas Personal Injury Trial Lawyer and Legal Analyst for Law & Crime Trial Network, Katherine Lizardo appeared on live TV a few days back to explain the nuances of Depp’s counter-appeal against Amber Heard. She stated: “It is no surprise that he filed a signal's appeal today, because… that was coming, I expected that to come soon. Especially since he added exhibit D to the final order of the judgment. And that’s very unusual, and it just signaled that he is prepared to take this to the next level, which would be filing an appeal.”
“It’s interesting how Johnny Depp’s team said that since Amber Heard wants to continue the litigation through appeal, then we have to file a counter-appeal. That signals to me that there might have been talks as to make sure that she doesn’t appeal,” the legal expert and commentator continued. “If you don’t appeal, then we won’t appeal. But if you make this type of action of filing another appeal, we will have no choice but to file our counter-appeal, which they did.”
She then discussed why this appeal could be a blessing in disguise for Depp, adding: “I think it’s a good thing for them, for Johnny Depp to file the appeal because the statement of issue that Waldman made, it was so convoluted in terms of there are many facts there that could be confusing to the jury and could be construed as not really something that should have been imputed to Johnny Depp. So, as a lawyer, I am looking forward to knowing that question of law as to what extent is your statement as a lawyer get imputed to your client.”
We know that the jury awarded Depp around $10 million in compensatory damages and punitive damages against Heard on June 1 of this year. Heard conversely won $2 million from Depp on claims that Depp’s lawyer Adam Waldman defamed her. Now, Johnny Depp has appealed the $2 million defamation award that the Virginia jury handed to his ex-wife Amber Heard. This news comes just a day after Amber Heard gave formal notice of intent to appeal the verdict in Johnny's defamation trial against her.
Waldman had told the British news outlet that Heard committed a ‘hoax’ when she called police to their apartment in May 2016. In an article published on 8 April 2020, Waldman had said, “Amber Heard and her friends in the media used fake violence allegations as both sword and shield, depending on their needs. They have selected some of her violence hoax ‘facts’ as the sword, inflicting them on the public and Mr. Depp.”
This statement, according to the legal expert, could have been very confusing to the jury, who may have failed in breaking down the legal details behind it properly and arrived at the wrong decision, In her opinion, this can be exploited by Depp’s legal team in their appeal to get a win.
