Chaudhary Perez Elahi, the provincial President of the Pakistan Muslim League Q, is currently the chief minister in Pakistan's Punjab province, who the PTI as its candidate.
On the first day of Perez Elahi taking over as the Chief Minister, his party Q-League convened an extraordinary meeting to claim the removal of party president Chaudhary Shujaat Hussain and Secretary General Tariq Bashir Cheema.
Chaudhary Shujaat maintains that they cannot do this legally. The party's Punjab General Secretary, Kamil Ali, has announced that the party's elections will be held within ten days to elect a new president.
Kamil Ali has referred to the party's constitution, saying, 'Under Clauses 118 and 119, if the President cannot run party affairs, the General Council can remove them. '
Kamil Ali said, 'Removing the party president is a legal process, and in the current situation of the party, Chaudhary Shujaat's health was coming in the way, which was a lot of tension within the party. '
He said, 'He (Chaudhary Shujaat Hussain) would have given an order one day and someone the next day, which caused anxiety within the party. He also stopped members from voting for his party candidate Chaudhary Perez Elahi, which was strange. The party finally decided to remove them, which happened by consensus.
In Pakistan, political parties have constitutions and procedures regarding the party's organizational structure within different political parties. According to legal experts, there are ways to remove and elect officials, including the President, within each party.
On the other hand, Chaudhary Shujaat Hussain's son-in-law Shaft Hussain told Urdu News, 'It was an illegal meeting with no status. Chaudhary Shujaat is the President of the Q-League, and the same is true of the Election Commission's records.'
He said, Kamil Ali is a provincial general secretary and cannot take any such step.
Interestingly, the party's constitution document is neither available on the party's website nor in the party office.
Former Secretary General Mushahid Hussain said, When I was the party's general secretary, probably framed the party's constitution in 2006, which laid down a procedure for the election of the party president. Under this procedure, the General Council will elect the President and secretary for three years. However, now I cannot say the status of the party's constitution at the moment. Some changes may have been made.
When contacted, Dr. Khalid, a legal minister and former legal minister of the party, said, 'Keep in mind that elections within the party constitution and parties in Pakistan are merely box-pre. There is no democracy in any party. '
According to Dr. Khalid, the Constitution of the Q-League says that the General Council can remove the President if he wants to. The party's constitution is also silent on whether the Punjab Secretary can call a meeting and discharge the Union President. '
He said, 'It remains to be seen how the Election Commission looks at the scene. If the Election Commission accepts the certificate of the new President on behalf of the party, then the matter is over. If the situation is another, the case may go on for a long time. '
