The Delhi High Court has seen that while the Right of Children to Free and Compulsory Education Act, 2009 ensures the right to instruction, notwithstanding, it no place gives that the said right can be unequivocally implemented against a confidential independent school. A division seat containing Acting Chief Justice Vipin Sanghi and Justice Sachin Datta maintained the legitimacy of Rules 35 (Striking off the name from the rolls) and 167 (Name of the understudy to be struck off for non-installment of charges and commitments) of Delhi School Education Rules, 1973.
